Our online platform (the Platform) allows you to both upload your own Content and discover Content from others. Additionally, you can also utilize the Platform to buy or sell various Products, including but not limited to photos, videos, and clips. Content means any material uploaded to the Platform by any user and Product means every product sold on our Platform.
We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains our practices with respect to the personal data we process about the users of our Services (Creators and Fans). This Privacy Policy explains: which data we collect, how we use, store and protect it and which privacy rights you can invoke. This Privacy Policy applies to our Platform and any other services or products we provide (the Services). This Privacy Policy applies to you as one of the following direct or indirect users of the Services:
Creators and Fans are herein collectively referred to as user(s) of the Services. If no specific user is mentioned in a paragraph or section hereof, this Privacy Policy applies to all users.
We may modify this Privacy Policy as our Services develop through time. If we substantially modify the Privacy Policy, we shall place a notification on our Platform. If you are a user of our Services, we advise you to consult the Platform and this Privacy Policy regularly.
Applicability
This Privacy Policy is provided in addition to our Terms of Service that govern your use of our Platform. The use of our Platform is intended for individuals of at least 18 years of age, or the minimum legal age required in your jurisdiction, whichever is higher. Anyone under the minimum legal age is not allowed to use our Platform. You will be requested to confirm that you are of the legal minimum age required. Where required by law we will verify your age.

We process personal data based on one of the legal grounds of the General Data Protection Regulation (GDPR). The relevant grounds for our Services are:
Personal data means any information about an individual with which information that person can be identified, directly or indirectly. Upon one of the demonstrable legal grounds specified under Section B (Data Processing) hereof, Fannilla™, or our third-party providers on our behalf, may process different kinds of personal data about you, which we have grouped together as follows:
1. Identity Data
First name, last name, username or similar identifier, third-party social media account username, tax identification number, date of birth, gender, government-issued picture identification (except for the national ID number on such document) and selfie photo.
2. Contact Data
Residential address, email address, and telephone number(s).
3. Financial Data
Payment method and financial data (such as credit card and/or bank account information), billing address, information related to your wallets (transfer of funds, transactions, balances), pay-out country, corporate or business entity (if registered for tax purposes), social security number (for US Creators only) or other relevant tax information.
4. Transaction Data
Creator: earnings, pay-out requests, payments made to your account, payments made from your account to other Creators, any failed payments. Fan: payments made from your account to Creators, any failed payments.
5. Technical Data
Internet protocol (IP) address, your login data, browser type and version, Internet Service Provider (ISP), time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access Fannilla™.
6. Content Data
Photos, videos, or other digital content uploaded to Fannilla™, including metadata that is provided with that content. Some data (e.g. Content you upload or purchase and your interests) may reveal information about your sex life or sexual orientation. We process such data only on the basis of your explicit consent, which you give when uploading/subscribing.
7. Account Data
Username and password, avatars and headers of your account, your subscriptions, subscribers and referrals, posts, comments, chat messages with other users, customer support queries, your interests, preferences, feedback, purchases and orders.

Information we receive when you sign up or log in via a third-party account (e.g. Google, X), such as your name, email address, profile picture and account ID

Fannilla™ stores your personal data only as long as it is necessary to fulfil the purposes mentioned in Section D (How We Process Your Personal Data), and for no longer than permitted under applicable law.
Identity/Contact Data: identity and age verification is performed by our verification provider on our behalf. The verification documents are retained by that provider: age verification documents for the duration to conduct the age verification (maximum of 48 hours), other identity and contact documents for as long as the account is active and 5 years following termination of the account, as required by law and payment network rules.
Financial/Transaction Data: financial and transaction data will be stored for the duration of 7 years
Technical Data: technical data will be stored for 6 to 26 months
Content/Account Data: content and account data will be stored for as long as the account is active increased with 30 days following termination of the account
Third Party Login Data: third party login data will be stored for 6 to 26 months
We do our utmost to protect your personal data, by taking technical and organizational security measures to protect your data against manipulation, loss, destruction and access by unauthorized persons or organizations. Our security measures are constantly improved in line with technological developments.
Although it's impossible to fully guarantee the security of your personal data in transit to us, we make a best effort and follow industry standards for safeguarding your data.

Service Providers
Fannilla™ may share personal data with the following categories of service providers, who contribute to our Services: hosting, data analysis and storage, payment processing, information technology and related infrastructure, customer service, product design, age and identity verification, content moderation, product diagnostics, email delivery, credit card processing, auditing, and marketing. Fannilla™ only shares personal data with service providers that provide sufficient safeguards to protect your personal data.
Competent Authorities
Fannilla™ discloses personal data to law enforcement authorities and other public authorities to the extent required by law or strictly necessary for the prevention, detection or prosecution of criminal offenses, fraud or copyright infringement.
Other users
Your username, avatar, posts, comments and messages are visible to the users you interact with. Creators can see which Fans subscribe to or purchase their Content.
Transfer
We may transfer personal data to third parties in the event that Fannilla™ is subject to a merger, acquisition, reorganization, sale of business units or bankruptcy. In this case, Fannilla™ will ask for your prior consent, if this is required under applicable law.
If the above organizations are regarded as processors under the GDPR, Fannilla™ will enter into a data processing agreement with them. In that case, processing of personal data will only take place on Fannilla™’s instruction and under our responsibility.
Fannilla™’s Services are managed and operated from the Kingdom of the Netherlands. We process personal data within the European Economic Area (EEA) to the extent possible and will only process personal data outside the EEA and will only transfer personal data to a country outside the EEA if that country has an adequacy decision (including the EU-US Data Privacy Framework) or if we have concluded the European Commission's Standard Contractual Clauses (2021/914). If necessary, we use the legally required safeguards for the transfer of personal data, such as the conclusion of an EU model contract.
